We have developed a robust notice management process to resolve notices faster. With that, we aim to provide a 100% guarantee for all notices issued under sections 139(9) and 143(1) of the Income Tax Act within one year of purchasing the plan purchased.

  • Section 139(9) pertains to a ‘Defective Return’.If the Income Tax Department finds inconsistencies or incomplete information in your return, a notice may be issued under this section. You have 15 days to rectify the defect in your return. Non-compliance will make the return invalid and lead to penalties. Our team will help you rectify this within one week of the order placed.
  • Section 143(1) Explained: The Income Tax Department sends an intimation under this section after preliminary assessing your return. It includes arithmetical errors, incorrect claims, discrepancies like unreported income evident in form 26AS, and tax calculation verification. If any tax is due or refunded, it will be indicated in this intimation. If there are tax dues, our team will help in handling responses in this regard.

There are two situations in which the notice management will be handled by Cleartax:

Situation 1 -The client filed a return using the Cleartax Assist PlanSituation 2 - The client has not filed a return via the Cleartax Platform.

When a user receives the notice from the department, these are the steps to be followed to resolve with Cleartax:

  • The user should send an email to support@cleartax.in.
  • The Cleartax team will now verify if the user is eligible for ClearAssist, and a response will be shared within 24-48 hours via an email, detailing the issue and offering a ClearAssist Plan with a discount coupon code.
  • The client can choose the plan, and a dedicated Tax Expert will assist in refiling the return by rectifying errors. All the communication would be done via email.
  • It should be noted that any outstanding tax liability or any penalty is the responsibility of the user.

Our role is to support in preparing and submitting the necessary documentation or responses as required. After our submission, the oversight of the process is transferred to the Income Tax Department. They will evaluate the submission, and any updates or additional instructions will be communicated directly to the user through the official website.
